The RICS have recently released these notes to assist surveyors in administration of party wall matters. Unfortunately it does not necessarily in all the circumstances account for a wider audience in the legal arena, be that as it may it is perhaps the single most authoritative reference for party wall matters and should be relied on in handling matters under the Party Wall etc. Act 1996.
As a word of caution, the most prevailing inference in a brief glance at this note is some of the new content is not necessarily as non-contentious as the legislation to which it relates was intended. Insofar as interpreting the intention of the parliament at the time, this is contrary to purpose of the legislation and practitioners should expect adverse litigation in some circumstances. I have contacted the publisher today in an attempt to try and alleviate this.
This note is “in force” from the 1st December 2019 onward.
